Product photographs, videos, renderings, illustrations, and lifestyle imagery are intended to represent products but may include styling elements or props that are not included with purchase unless expressly stated.
We may modify product designs, materials, packaging, specifications, features, colors, availability, or descriptions without prior notice, provided that any product supplied materially conforms to the description applicable to the order at the time of purchase, subject to applicable law.
We may discontinue products or limit quantities available to any person, household, geographic area, or jurisdiction.

Bath Bomb Key products must be used only for their intended purpose and in accordance with any instructions, warnings, labels, or other information provided with the product or on the Services.
Bath Bomb Key is not a toy and is not intended for use by children.
Keep Bath Bomb Key products out of the reach of children.
You are responsible for using the product with reasonable care and for inspecting it before use.
Do not use a product that appears cracked, broken, materially damaged, altered, or otherwise unsafe.
Do not intentionally modify, reshape, sharpen, dismantle, or use a Bath Bomb Key product in a manner inconsistent with its intended purpose.
To the fullest extent permitted by law, Bath Bomb Key is not responsible for injury, loss, or damage caused by misuse, unintended use, unauthorized modification, failure to follow instructions or warnings, use of a damaged product, or other use inconsistent with these Terms.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

SECTION 4 - ORDERS

Submitting an order constitutes an offer to purchase.
An order is not accepted until we confirm acceptance or otherwise begin fulfillment.
We reserve the right to accept, decline, limit, or cancel an order where permitted by law, including because of:

Pricing or listing errors
Suspected fraud
Payment issues
Unauthorized resale activity
Shipping restrictions
Violations of these Terms
Other legitimate business or legal reasons
If we cancel an order after payment has been processed, we will issue any refund required by applicable law.
Please review your order carefully before submitting it. We may be unable to accommodate cancellation or modification requests once fulfillment has begun.

SECTION 5 - PERSONAL USE AND UNAUTHORIZED RESALE

Unless otherwise approved by Bath Bomb Key in writing, products purchased through the Services are intended for personal or household use.
You may not purchase products for unauthorized commercial resale, distribution, export, marketplace resale, dropshipping, or other commercial exploitation.
This restriction does not prohibit resale by retailers, wholesalers, distributors, affiliates, promotional partners, or other businesses expressly authorized by Bath Bomb Key.
We may limit quantities, cancel orders, restrict accounts, or take other reasonable action when we believe purchases are intended for unauthorized resale.

SECTION 6 - PRICES, PAYMENT, AND BILLING

Prices, discounts, promotions, and availability may change without notice.
The price charged will generally be the price displayed when your order is submitted, subject to correction of genuine errors as permitted by law.
Unless otherwise stated, prices do not include applicable taxes, shipping, handling, customs charges, or other charges that may apply.
Prices offered through our website may differ from prices available through Amazon, Etsy, retailers, promotions, affiliates, marketplaces, or other sales channels.
Promotions may be subject to separate terms. If promotional terms conflict with these Terms with respect to that promotion, the promotional terms will control.
You agree to provide accurate and complete payment and billing information.
You represent that you are authorized to use the payment method submitted.
Payment processing may be provided by Shopify or third-party payment processors and may be subject to their terms.

SECTION 7 - SHIPPING AND DELIVERY

Orders are subject to our Shipping Policy, which is incorporated into these Terms by reference.
Shipping and delivery dates are estimates unless we expressly state otherwise.
We will comply with applicable laws concerning promised shipment times, delays, cancellations, and refunds.
You are responsible for providing a complete and accurate delivery address.
We are not responsible for delays caused by carriers, severe weather, natural events, transportation disruptions, governmental action, incorrect customer information, or other circumstances outside our reasonable control, except to the extent applicable law provides otherwise.
If shipment is delayed beyond a legally applicable or expressly promised timeframe, we will provide any notice, cancellation option, or refund required by law.
Unless otherwise required by law, risk of loss passes to you upon delivery to the shipping address provided with your order.

SECTION 8 - RETURNS AND REFUNDS

Purchases made directly from Bath Bomb Key are subject to our Refund Policy, which is incorporated into these Terms by reference.
Our current Refund Policy provides a seven-day return-request window and requires customers to pay applicable return shipping, subject to the terms, exclusions, exceptions, and rights stated in that policy and any nonwaivable rights under applicable law.
Purchases made through Amazon, Etsy, retailers, or other third parties may be governed by the return and refund policies applicable to those sales channels.

SECTION 9 - NO EXPRESS PRODUCT WARRANTY

Except for any express written commitment we specifically provide at the time of sale, Bath Bomb Key does not provide a separate voluntary product warranty.
This section does not eliminate any warranty, remedy, or consumer right that cannot lawfully be disclaimed or limited.
To the fullest extent permitted by law, implied warranties are disclaimed as described more fully in the Disclaimer of Warranties section below.

Proprietary product information
Other original or proprietary content
Public display or availability of any Bath Bomb Key content does not grant you ownership or a license except as expressly stated in these Terms.
You may view the Services for personal, noncommercial purposes.
Except with our prior written permission or as otherwise permitted by law, you may not:

SECTION 11 - PHOTOGRAPHY, VIDEO, LIKENESSES, AND SOCIAL CONTENT

Bath Bomb Key content may include photographs, videos, recordings, voices, likenesses, names, or other depictions of individuals, including members of our founders’ family or other persons appearing with permission.
The inclusion of any person in Bath Bomb Key content does not grant any third party permission to copy, extract, reproduce, alter, manipulate, republish, distribute, commercialize, train models on, create derivatives from, or otherwise use that person’s image, likeness, voice, identity, or depiction.
Without prior written authorization, you may not use Bath Bomb Key imagery or recordings to:

Create altered or synthetic images or video
Create deepfakes
Create impersonations
Generate digital replicas
Train facial-recognition or biometric systems
Train artificial-intelligence or machine-learning systems
Create datasets
Create derivative advertising or promotional materials
Suggest endorsement, sponsorship, affiliation, or approval
Commercially exploit any depicted person
These restrictions apply to content on our website and to Bath Bomb Key-owned or controlled social-media channels, advertisements, marketplace listings, email communications, and other official marketing channels.
Nothing in this section restricts lawful uses that cannot legally be prohibited.

SECTION 12 - AUTOMATED ACCESS, SCRAPING, AI TRAINING, AND SEARCH DISCOVERY

We support legitimate search, product discovery, and services that help consumers find Bath Bomb Key.
Subject to our technical instructions and applicable law, we permit legitimate search engines, shopping search services, and discovery tools to crawl or index publicly accessible portions of the Services solely for bona fide search, indexing, caching, snippet display, product discovery, or directing users to Bath Bomb Key.

Any automated system accessing the Services must comply with applicable technical instructions and must not misrepresent its identity or purpose.
We may block or restrict automated access at any time.

SECTION 13 - THIRD-PARTY TOOLS

We may provide access to tools, applications, payment methods, integrations, or other functionality supplied by third parties.
Third-party tools may be governed by separate terms and privacy policies.
To the fullest extent permitted by law, Bath Bomb Key is not responsible for third-party tools or services that we do not control.
Your use of third-party tools is at your own discretion and subject to the applicable third party’s terms.

Bath Bomb Key products may be available through Amazon, Etsy, retailers, or other third-party sales channels.
Purchases made through those channels may be subject to the applicable marketplace or retailer’s terms, policies, fulfillment rules, return procedures, dispute processes, and other requirements.
These Terms apply to your use of Bath Bomb Key’s Services and, where legally applicable, to your relationship with Bath Bomb Key, but they do not override mandatory marketplace or retailer terms governing a transaction placed through a third-party channel.

SECTION 16 - RELATIONSHIP WITH SHOPIFY

Bath Bomb Key is powered by Shopify, which enables us to provide the Services to you.
However, sales and purchases made through our Store are made directly with Bath Bomb Key LLC.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Bath Bomb Key, including any injury, damage, or loss resulting from purchased products and services.
To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Bath Bomb Key.
Nothing in this section limits rights that cannot lawfully be waived.

If you voluntarily submit ideas, suggestions, product feedback, recommendations, comments, or other feedback specifically for Bath Bomb Key’s consideration (“Feedback”), you represent that you have the right to provide it.
Unless we agree otherwise in writing, Feedback is not confidential.
You grant Bath Bomb Key a worldwide, perpetual, irrevocable, nonexclusive, transferable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, display, distribute, commercialize, and otherwise use Feedback for lawful business purposes.
You acknowledge that Bath Bomb Key may already be developing concepts similar to submitted Feedback and that submission does not create an obligation to compensate you or use the Feedback.

SECTION 19 - USER-GENERATED CONTENT

Customer photographs, videos, social-media posts, testimonials, reviews, comments, and similar content created independently by customers or third parties (“User-Generated Content” or “UGC”) reflect the views and experiences of the person who created them and do not necessarily represent the views, claims, opinions, or statements of Bath Bomb Key.
Bath Bomb Key does not automatically obtain a commercial-use license merely because a person:

Uses a Bath Bomb Key hashtag
Posts content featuring a Bath Bomb Key product
If Bath Bomb Key wishes to reproduce, repost, advertise with, edit, commercially use, or otherwise obtain broader rights in UGC, we may request permission from the content owner.
Any commercial or promotional use by Bath Bomb Key will be governed by the permission, license, agreement, campaign terms, or other authorization applicable to that content.
We may display customer reviews submitted directly through functionality intended for publication, subject to the review platform’s terms and applicable law.
We may remove UGC from our Services where permitted, including content that is unlawful, infringing, fraudulent, abusive, misleading, obscene, malicious, or otherwise inappropriate.

SECTION 20 - AFFILIATES, CREATORS, INFLUENCERS, PARTNERS, AND THIRD-PARTY STATEMENTS

Bath Bomb Key may work with affiliates, bloggers, creators, influencers, ambassadors, publishers, retailers, advertising partners, reviewers, or other third parties.
Unless Bath Bomb Key expressly states otherwise in writing, these persons and organizations are independent third parties and are not employees, agents, legal representatives, or authorized spokespersons of Bath Bomb Key.
Their opinions, statements, recommendations, representations, demonstrations, claims, or other content are their own and do not necessarily represent Bath Bomb Key.
No partner has authority to make warranties, guarantees, promises, commitments, or legally binding representations on behalf of Bath Bomb Key unless expressly authorized in writing.
We expect compensated or incentivized promotional partners to make disclosures required by applicable advertising and endorsement laws.

SECTION 21 - ERRORS, INACCURACIES, AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical errors concerning product descriptions, pricing, promotions, availability, shipping charges, transit times, or other matters.
We may correct errors, update information, or cancel an affected order where permitted by applicable law.
If an order is canceled after payment because of an error, we will issue any required refund.

Create counterfeit, confusingly similar, copied, or derivative products
Misrepresent an affiliation with Bath Bomb Key
We may suspend or terminate access for violations of this section.

SECTION 23 - TERMINATION

We may suspend, restrict, or terminate access to the Services where permitted by law, including for violations of these Terms, suspected fraud, security concerns, misuse, or conduct harmful to Bath Bomb Key or others.
Termination does not eliminate payment obligations or other obligations incurred before termination.
Sections that by their nature should survive termination will survive, including provisions relating to intellectual property, content rights, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law.

SECTION 24 - DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” EXCEPT TO THE EXTENT BATH BOMB KEY EXPRESSLY AGREES OTHERWISE IN WRITING.
TO THE FULLEST EXTENT PERMITTED BY LAW, BATH BOMB KEY DISCLAIMS EXPRESS OR IMPLIED WARRANTIES NOT EXPRESSLY PROVIDED BY US, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE WEBSITE OR OTHER DIGITAL SERVICES WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE.
SOME STATES DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS OR LIMITATIONS. NOTHING IN THESE TERMS EXCLUDES ANY WARRANTY, REMEDY, OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.

SECTION 25 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BATH BOMB KEY LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF USE, OR SIMILAR LOSSES ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, BATH BOMB KEY WILL NOT BE LIABLE FOR LOSS, DAMAGE, OR INJURY ARISING FROM:

Misuse of a product
Use for an unintended purpose
Failure to follow instructions or warnings
Unauthorized modification
Use of a damaged product
Conduct of an independent third party
Third-party services
Events outside our reasonable control
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
WHERE APPLICABLE LAW DOES NOT PERMIT A PARTICULAR EXCLUSION OR LIMITATION, THAT EXCLUSION OR LIMITATION WILL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

SECTION 26 - INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Bath Bomb Key LLC and its members, managers, officers, employees, agents, affiliates, licensors, contractors, and service providers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from:

Your unlawful use of the Services
Your infringement of another person’s rights
Your unauthorized commercial exploitation of Bath Bomb Key content
Your unauthorized resale, scraping, copying, or misuse of our intellectual property
This section does not require a consumer to indemnify Bath Bomb Key for Bath Bomb Key’s own conduct where such indemnification is prohibited by law.

SECTION 27 - DISPUTE RESOLUTION AND BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution

Before initiating arbitration or litigation, you and Bath Bomb Key agree to make a good-faith effort to resolve the dispute informally.
The party asserting a dispute must provide written notice describing the dispute and requested relief.
Notices to Bath Bomb Key should be sent to help@bathbombkey.com.
If the dispute has not been resolved within 30 days after receipt of the notice, either party may proceed as permitted below.
This informal-resolution requirement does not prevent either party from seeking urgent injunctive relief where delay could cause irreparable harm.

Agreement to Arbitrate

Except for disputes excluded below and except where prohibited by applicable law, you and Bath Bomb Key agree that any dispute, claim, or controversy arising out of or relating to:

Marketing or communications
Your relationship with Bath Bomb Key
will be resolved by individual binding arbitration rather than in court.

Federal Arbitration Act

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement to the extent applicable.

Arbitration Administrator

Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and Mediation Procedures then in effect, as modified by these Terms to the extent permitted.
If AAA is unavailable or unwilling to administer a particular dispute, the parties will attempt in good faith to agree on another nationally recognized arbitration provider. If they cannot agree, a court of competent jurisdiction may appoint an arbitrator or administrator as permitted by law.

Arbitration Location and Format

The arbitration may be conducted remotely, by documents, telephone, videoconference, or in person as permitted under applicable AAA rules.
Any in-person hearing will occur at a location reasonably convenient to the consumer or as otherwise required by applicable law or AAA rules.

Small Claims Court

Either party may bring an eligible individual claim in small claims court instead of arbitration, provided the claim remains individual and within that court’s jurisdiction.

Intellectual Property and Protective Relief

Notwithstanding the arbitration requirement, Bath Bomb Key may seek temporary, preliminary, or permanent injunctive or equitable relief in a court of competent jurisdiction to protect against:

Intellectual-property infringement
Trademark infringement
Counterfeiting
Copyright infringement
Trade-secret misappropriation
Unauthorized scraping
Unauthorized AI training
Unauthorized use of imagery, likenesses, content, or product designs
Circumvention of technical protections
Other conduct causing or threatening irreparable harm to Bath Bomb Key’s intellectual-property or proprietary rights
Seeking such relief does not waive arbitration of other arbitrable claims.

Individual Proceedings Only

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND BATH BOMB KEY AGREE THAT ARBITRATION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS.
NEITHER PARTY MAY BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE ARBITRATION EXCEPT TO THE EXTENT SUCH A WAIVER IS PROHIBITED BY APPLICABLE LAW.
THE ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY’S INDIVIDUAL CLAIM, EXCEPT WHERE APPLICABLE LAW REQUIRES OTHERWISE.

Jury Trial Waiver

For claims subject to arbitration, you and Bath Bomb Key knowingly waive the right to a trial before a judge or jury, subject to applicable law.

Arbitration Fees

Arbitration fees and costs will be allocated according to the applicable AAA Consumer Arbitration Rules and applicable law.
Bath Bomb Key will pay fees that it is required to pay under AAA rules or applicable law.
Nothing in these Terms requires a consumer to pay arbitration costs that would make the arbitration provision legally unenforceable.

30-Day Right to Opt Out

You may opt out of this arbitration agreement by sending written notice within 30 days after the date you first become bound by these Terms.
Your notice must include:

A clear statement that you are opting out of the arbitration agreement in the Bath Bomb Key Terms of Service

Opting out of arbitration will not affect your purchase, account, or access to the Services.
An opt-out applies only to the individual who timely submits it.

State-Law and Nonwaivable Rights

This arbitration section applies only to the extent permitted by applicable law.
If applicable state or federal law prohibits arbitration of a particular claim or prevents enforcement of a particular provision, that claim or provision will be treated as required by law without invalidating the remainder of this section where severance is legally permitted.

Severability of Arbitration Terms

If any portion of this arbitration agreement is found unenforceable, the remainder will remain enforceable to the fullest extent permitted by law, except where applicable law requires a different result.

SECTION 28 - GOVERNING LAW AND VENUE

Except to the extent governed by the Federal Arbitration Act or another mandatory law, these Terms and disputes arising from them are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.
For any dispute that is not required to be arbitrated and is not properly brought in small claims court elsewhere as permitted by these Terms or applicable law, you and Bath Bomb Key consent to the exclusive jurisdiction and venue of the state courts located in Hennepin County, Minnesota, and the applicable federal court serving Hennepin County.
Nothing in this section deprives a consumer of a nonwaivable right or venue protection provided by applicable law.

SECTION 29 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.
The remaining provisions will remain in full force and effect unless applicable law requires otherwise.

SECTION 30 - WAIVER

Failure by Bath Bomb Key to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
A waiver is effective only if made in writing by an authorized representative of Bath Bomb Key.

SECTION 31 - ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any additional terms expressly incorporated by reference, constitute the entire agreement between you and Bath Bomb Key concerning the subject matter addressed by them.
They supersede prior or contemporaneous communications concerning that subject matter, except for separate written agreements signed or expressly accepted by Bath Bomb Key.

SECTION 32 - ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.
Bath Bomb Key may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, financing, restructuring, corporate reorganization, or other legitimate business transaction.

SECTION 33 - NO THIRD-PARTY BENEFICIARIES

Except where expressly stated otherwise, these Terms do not create rights in any person or entity other than you and Bath Bomb Key.

Headings are provided for convenience only and do not affect interpretation of these Terms.

SECTION 35 - CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our Services, business practices, products, technology, legal obligations, or operations.
We will post the updated Terms and revise the “Last updated” date.
Where required by law, we will provide additional notice or obtain renewed agreement before applying a material change.
Changes will not retroactively eliminate rights or obligations that cannot lawfully be modified without consent.
